1. Acceptance of Terms

By accessing the NKSPAIR website or using the NKSPAIR mobile application, you agree to be bound by these Terms of Service. If you do not agree, please do not use our products or services.

2. Use of Service & Account

Eligibility: You must be at least 18 years old to create an account.

Account Security: You are responsible for maintaining the confidentiality of your login credentials. NKSPAIR is not liable for unauthorized access resulting from your failure to secure your account.

3. Smartlink Hardware: Installation & Safety

Retrofit Nature: Smartlink is a retrofit module designed to be installed inside existing switchboards.

Professional Installation: We strongly recommend that Smartlink be installed by a certified electrician.

Liability Waiver: NKSPAIR is not liable for any damage, electrical fires, or injuries resulting from improper installation, tampering with the module, or use of the module with incompatible appliances (e.g., exceeding the rated load of 10A/16A).

Manual Override: Smartlink is designed to work alongside manual switches. In the event of a Wi-Fi or Cloud failure, the manual switch functionality is the primary fallback.

4. Software License & Updates

License: We grant you a limited, non-exclusive, non-transferable license to use the NKSPAIR App for personal home automation.

Updates: NKSPAIR may push mandatory firmware updates to your Smartlink module to improve security or functionality. You agree to allow these updates to ensure device safety.

5. Prohibited Activities

You agree not to:

• Reverse-engineer or decompile the Smartlink hardware or app software.
• Use the Service for any illegal or unauthorized purpose.
• Interfere with the security-related features of the Smartlink module.

6. Website Intellectual Property

All content on the NKSPAIR website, including the "Visible Comfort. Invisible Tech." slogan, logos, and product designs, is the intellectual property of NKSPAIR. Unauthorized use is strictly prohibited.

7. Limitation of Liability

To the maximum extent permitted by Indian law:

• NKSPAIR shall not be liable for any indirect, incidental, or consequential damages (including loss of data or home appliance failure).
• Our total liability for any claim shall not exceed the amount you paid for the Smartlink hardware.

8. Warranty & Returns

Warranty: Smartlink comes with a 1-year limited warranty against manufacturing defects.

Voiding Warranty: The warranty is void if the device is opened, physically damaged, or subjected to electrical surges beyond specified limits.

9. Termination

We reserve the right to suspend or terminate your account access if you violate these terms or engage in fraudulent activity.

10. Governing Law & Jurisdiction

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.
